By purchasing or subscribing to the Busy-B HIVE Subscription (“Subscription”), you agree to the following Terms and Conditions.
Overview
The Busy-B HIVE Subscription provides subscribers with access to digital educational resources, teaching materials, and related content on a recurring subscription basis. By subscribing, you agree to comply with and be bound by these Terms and Conditions.
Eligibility
You must be at least 18 years old to purchase a subscription. By subscribing, you confirm that you have the authority to enter into this agreement.
Subscription Plans & Billing
Subscription Options We offer:
1. Monthly Subscription: $15 AUD per month
2. Annual Subscription: $150 AUD per year
All prices are listed in Australian Dollars (AUD).
Automatic Renewal
Subscriptions renew automatically at the end of each billing cycle (monthly or annually) unless cancelled prior to renewal.
Payment
Payment is processed through our secure payment provider. You agree to provide accurate billing information and authorise recurring charges. If payment fails, access may be suspended until payment is successfully processed.
Cancellation Policy
You may cancel your subscription at any time.
Upon cancellation:
1. You will retain access until the end of your current billing period.
2. Your subscription will not renew after that period.
3. No refunds (including partial) will be issued for unused time.
4. Cancellation must be completed through your account portal or by written request before the renewal date.
Refund Policy
Due to the digital and downloadable nature of the resources provided under this Subscription, all sales are final. We do not offer refunds, exchanges, or credits for:
1. Change of mind
2. Failure to download materials
3. Unused subscription periods
4. School budget changes
This policy complies with Australian Consumer Law. Nothing in these Terms excludes rights you are entitled to under Australian Consumer Law.
Access to Resources
Active Subscription Requirement
Access to the Subscription resource library is granted only while your subscription is active.
If your subscription lapses or is cancelled:
1. Access to the online library will cease.
2. Previously downloaded materials may continue to be used in accordance with the Licence Agreement below.
Resource Rotation
Resources may rotate term by term.
We reserve the right to:
1. Add new resources
2. Update existing materials
3. Remove or archive resources
4. Content availability is not guaranteed indefinitely.
Licence Agreement – Single Teacher Use
Upon subscription, you are granted a non-exclusive, non-transferable, single-teacher licence to use the materials.
You may:
1. Use resources in your own classroom
2. Share materials directly with your students
3. Print and distribute materials to your students
You may not:
1. Share resources with other teachers
2. Upload files to shared drives accessible by multiple staff
3. Distribute materials beyond your classroom
4. Resell, sublicense, or commercially exploit the materials
5. Modify and redistribute materials as your own work
Each teacher must hold their own individual subscription unless a School Subscription Licence has been purchased.
School Subscription Licence
Schools or faculties wishing to provide access to multiple teachers must purchase a School Subscription Licence.
School Licences:
1. Cover multiple nominated teachers within one school campus
2. May not be shared across separate campuses unless agreed in writing
To enquire about School Subscription pricing, schools must contact us directly.
Intellectual Property
All materials, resources, designs, text, graphics, branding, and content remain the intellectual property of Busy-B.
1. Unauthorised reproduction, distribution, or sharing may result in:
2. Immediate termination of subscription
3. Revocation of access
4. Legal action where necessary
Founding Member Promotion
The Founding Member free gift:
1. Is limited to the first 30 subscribers
2. Is available while allocation lasts
3. Is limited to one per subscriber
4. Requires a valid Australian postal address
We reserve the right to substitute the gift with an item of equal value if required.
Storewide Discount
The 10% subscriber discount:
1. Applies while subscription is active
2. Cannot be combined with other promotional codes unless stated
May be modified or withdrawn with reasonable notice
Account Security
Subscribers are responsible for maintaining the confidentiality of their login credentials.
You agree not to:
1. Share your login details
2. Allow unauthorised access
3. Create multiple accounts to bypass restrictions
We reserve the right to suspend accounts suspected of misuse.
Modifications to Subscription
We reserve the right to:
1. Adjust pricing with reasonable notice
2. Modify subscription inclusions
3. Update these Terms and Conditions
Continued use of the Subscription after changes constitutes acceptance of the updated Terms.
Limitation of Liability
To the maximum extent permitted by law:
Busy-B shall not be liable for:
1. Indirect or consequential losses
2. Loss of revenue or school funding
3. Technical interruptions beyond our control
4. Misuse of materials
Our total liability is limited to the amount paid by you in the preceding billing period.
Nothing in these Terms excludes your rights under Australian Consumer Law.
Termination
We reserve the right to terminate or suspend your subscription immediately if you breach these Terms. No refunds will be provided in cases of breach.
Governing Law
These Terms are governed by the laws of New South Wales, Australia.
Any disputes will be subject to the jurisdiction of the courts of New South Wales.
